For the "hidden rules" referred to above, according to Article 31 of the "Regulations on the Administration of Motor Vehicle Maintenance" issued by the Ministry of Communications' No. 7 Dec 2005, "Motor Vehicle Maintenance Operators shall pay for the replaced parts and assemblies. The caretaker will handle it on his own.†Since the purchase of the car, the consumer has owned the car, including any accessories and facilities on the car. In order to distinguish the refurbished parts in the current market where the sources of the channels are chaotic and quality is difficult to guarantee, the "Circular Economy Promotion Law" clearly stipulates two major preconditions: First, the remanufactured products and refurbished products for sale must be "conformed to the relevant national standards". The second is that it must be marked as a remanufactured product or a refurbished product in a prominent position. Where the remanufactured or refurbished product is not clearly marked, the local administrative department for industry and commerce shall order it to make correction within a time limit, and may impose a "fine of 5,000 yuan up to 50,000 yuan." The fine of at least 5,000 yuan and a maximum of 50,000 yuan, if the illegal sellers still do not play a deterrent effect, and illegally refurbish the sales of spare parts will not be overdue, the administrative department for industry and commerce shall have the right to revoke its business license. If it causes losses to consumers, it shall bear corresponding responsibilities according to law.
